1. Acceptance of Terms

By accessing or using the CodePlay website, enrolling in our educational pathways, or attending our campuses, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Mokuni LLC. If you are registering a minor (under 18), you agree to these terms on their behalf.

2. Description of Services

CodePlay is a gamified STEM education platform offering online pathways, software architecture tools, and physical campus resources for students in Grades 3-12. We reserve the right to modify, suspend, or discontinue any aspect of our curriculum, campus access, or platform features at any time without prior notice.

3. User Accounts and Registration

  • Eligibility: Account registration and enrollment must be completed by an adult (18 years or older).
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
  • Accuracy: You agree to provide accurate, current, and complete information during registration and keep your account details updated.

4. Code of Conduct

To maintain a safe and productive gamified learning environment, all students and users must adhere to our Code of Conduct. The following behaviors are strictly prohibited:

  • Cyberbullying, harassment, or using discriminatory language.
  • Attempting to hack, exploit, or bypass the security of the CodePlay platform or third-party educational tools.
  • Sharing account credentials or distributing course materials to unauthorized parties.

Violation of the Code of Conduct may result in immediate suspension or termination of the student's enrollment without a refund.

5. Intellectual Property Rights

All content, materials, software, curriculum designs, logos (including the CodePlay Icon), and text on this platform are the intellectual property of Mokuni LLC and are protected by applicable copyright and trademark laws.

Student Projects: Students retain ownership of the original code, artwork, and projects they create during their enrollment. However, by participating in CodePlay, you grant Mokuni LLC a non-exclusive license to showcase student projects in our galleries and marketing materials.

6. Payment and Refund Policies

  • Tuition: Payments for online pathways, hybrid cohorts, and private mentorship must be made in full prior to the start of the semester.
  • Refunds: We offer a full refund if enrollment is canceled at least 14 days before the start date. No refunds are provided after the first week of classes.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Mokuni LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of our services.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New York County, New York, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
